Highlights Aviation Law and Litigation:
- Advised the South African Civil Aviation Authority and Denel Aviation on a number of aviation related matters including litigation flowing there from.Competition Law
- Advised the Competition Commission on the provisions of the Competition Act, the Long and Short-term Insurance Acts and the Banks Act on issues relating to the respective jurisdictions of the Competition Commission, the Insurance Ombudsman and the Banking Adjudicator.
- Was involved in an advisory capacity with the Competition Tribunal on decisions that the Tribunal had taken and were being referred to the Competition Appeal Court on appeal or review.
- Advised South African Airways (SAA) in its application on the code share agreement it concluded with Qantas.
Commercial Litigation and Corporate Law:
- Represented the Industrial Development Corporation (IDC), Development Bank of Southern Africa (DBSA) and Business Partners Limited in various matters relating to their financing structures and recovery of amounts due to them, including investigations on fraudulent trading transactions leading to Section 424 of the Companies Act proceedings.
- Represented and the South African Broadcasting Corporation (SABC) on various litigation matters both in the High Court and through Arbitration proceedings
- Represented Telkom in various litigation matters
Constitutional and Administrative Law:
- Represented the Gauteng Gambling Board in review applications instituted against it after the recommendations that were made in respect of casino licences within the Gauteng Province.Represented Transnet the City of Johannesburg and the Merafong Local City Municipality on various review applications instituted against them resulting from the awarding of tenders. Provided an opinion to the City of Johannesburg on their supply chain management policies in relation to the infrastructure workshop in preparation for the 2010 World Cup Soccer tournament.
- Represented Telkom in the urgent review instituted by Cosatu relating to the sale of Vodacom shares.
- Provided various opinions to Municipalities, Regulatory Bodies and other parastatals on various aspects relating to administrative and regulatory processes, and Local Government Legislation
- Represented ICASA (they SATRA) in the review application launched by NEXTCOM Holdings regarding the awarding of the third cellular license.
Regulatory:
- Involved in the drafting of the regulations pertaining to the Gauteng Tourism Act and regulations in respect of the third cellular licence with ICASA (formerly SATRA).
- Reviewed the provisions of the Gas Act 48 of 2001, Petroleum Pipelines Act 60 of 2003 and Electricity Act 4 of 2006 and provided an opinion thereon to NERSA, in relation to the Functus Officio principle.
- Advised a Water Services Provider on the provisions of the Water Services Act and the Regulations thereto, including the relevant application and/or overlaps with the provisions of the Municipal Systems Act.
- Advised the Merafong City Local Municipality on the provisions of the Municipal Finance Management Act, read with the Municipal Structures Act and Municipal Systems Act, in relation to various contracts that were concluded with external parties.
- Reviewed the provisions of he Promotion of Access to Information Act, drafted manuals thereon for two public entities and represented various parties on litigation relating to the provisions of the said Act.
- Reviewed and analysed the provisions of the Regulation of Interception of Communication and Provision of Communication – Related Information Act 70 of 2002 (RICA) and co-authorised an article titled "Understanding the impact of RICA."
